Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Kriseena platform. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Parties

These Terms are between Daanbi Services Ltd, a company incorporated in England and Wales ("Kriseena", "we", "us"), and you, the individual or legal entity agreeing to these Terms ("Customer", "you"). By accepting these Terms you represent that you have authority to bind yourself or your organisation.

2. The Service

Kriseena is a cloud-based AI customer support platform that enables businesses to automate and manage customer conversations via chat widgets, email integrations, and a unified agent inbox. The Service is provided on a subscription basis as described on our pricing page.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must notify us immediately at support@kriseena.com if you suspect any unauthorised access to your account.
  • You must be at least 18 years old to create an account.

4. Subscription Plans and Payment

  • Subscriptions are billed monthly in advance. All prices are in US Dollars (USD) unless stated otherwise.
  • Payments are processed by Stripe. By subscribing you agree to Stripe's terms of service.
  • Subscriptions automatically renew unless cancelled before the next billing date.
  • We reserve the right to change pricing with at least 30 days' written notice to registered users. Price changes take effect at the next renewal after the notice period.
  • All fees are non-refundable except as required by applicable UK consumer law.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations.
  • Send spam, unsolicited communications, or harassing messages.
  • Upload or transmit malicious code, viruses, or harmful content.
  • Attempt to reverse-engineer, scrape, or interfere with the Service.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Use the Service to process or store sensitive personal data categories as defined under UK GDPR (e.g. health, financial, or biometric data) without a separate data processing agreement with us.

We reserve the right to suspend or terminate accounts that violate this section without notice.

6. Your Data and Content

You retain full ownership of all content you upload to the Service, including knowledge base articles, conversation data, and integration credentials. By using the Service, you grant Daanbi Services Ltd a limited, non-exclusive licence to process this content solely for the purpose of providing the Service to you. We will not use your data to train AI models or share it with third parties except as described in our Privacy Policy.

7. AI-Generated Responses

Kriseena uses large language models to generate automated responses to your customers. You acknowledge that AI-generated responses may occasionally be inaccurate or incomplete. You are responsible for reviewing AI drafts before sending where required, and for ensuring that the Service is configured appropriately for your use case. We are not liable for any loss or damage arising from AI-generated content delivered to your customers.

8. Intellectual Property

The Kriseena platform, including its software, design, trademarks, and documentation, is owned by Daanbi Services Ltd and protected by intellectual property laws. These Terms do not grant you any rights in our intellectual property other than the limited right to use the Service as described herein.

9. Availability and Support

We aim to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. Support is provided by email at support@kriseena.com. Response times vary by plan and are not contractually guaranteed unless specified in a separate agreement.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Daanbi Services Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total fees paid by you in the three months preceding the event giving rise to the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law.

11. Indemnification

You agree to indemnify and hold harmless Daanbi Services Ltd and its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any third-party rights.

12. Termination

Either party may terminate the subscription at any time. Your access to the Service will continue until the end of the current billing period. We reserve the right to suspend or terminate your account immediately for material breach of these Terms, including violations of the Acceptable Use policy. Upon termination, your data will be retained for 90 days and then permanently deleted, unless you request earlier deletion.

13. Changes to These Terms

We may update these Terms from time to time. We will provide at least 14 days' notice via email before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
